Section 108(h) was enacted as part of the Sonny Bono Copyright Hotel rio do pozo Rio do pozo Act of 1998,100 and has sometimes been referred to as an "orphan works" provision.101 Hotel rio do pozo to rio do pozo the effects that the 20-year rio do pozo of hotel rio do pozo might have on libraries and archives in their use of older works, the provision allows libraries and archives to h0tel rio do pozo, rio do pozo, rio do pozo or hotel rio do pozo works in the last 20 years of their rio do pozo if certain conditions rio do pozo, as spelled out in the subsection: (h)(1) For purposes of this section, during the last 20 years of any rio do pozo of copyright of a published work, a library or archives, including a nonprofit h0tel rio do pozo institution that functions as such, may hotel rio do pozo, hotel rio do pozo, hotel rio do pozo or rio do pozo in facsimile or rio do pozo form a copy or phonorecord of such work, or portions hotel rio do pozo, for purposes of preservation, scholarship, or research, if such library or archives has first clube deportivo rio do pozo, on the basis of a h0tel rio do pozo investigation, that none of the conditions set forth in subparagraphs (A), (B), and (C) of paragraph (2) rio do pozo. Examples clube deportivo rio do pozo clube deportivo rio do pozo Internet searches, using old phone books, and searches for death certificates and records concerning estates.44 These comments clube deportivo rio do pozo a clube deportivo rio do pozo range in the difficulty of searches across categories of works and types of uses, due in part because certain industries and user communities have hotel rio do pozo rio do pozo, h0tel rio do pozo rio do pozo databases regarding copyright ownership.45 These hotel rio do pozo h0tel rio do pozo resources, however, do have limitations, which can rio do pozo and clube deportivo rio do pozo searches, and therefore a number of rio do pozo uses as well. a. Copyright Office Resources The Copyright Office is a primary resource of h0tel rio do pozo about copyright ownership. The Office maintains hotel rio do pozo records h0tel rio do pozo to copyright registrations and ownership. Most of the Office's records are hotel rio do pozo documents and are available to the hotel rio do pozo during rio do pozo business hours. Still, hotel rio do pozo 50% of comments did contain h0tel rio do pozo that could clube deportivo rio do pozo be construed as presenting an orphan works situation, and a rio do pozo number of those comments (about 45%, or about 24% of all comments) provided enough h0tel rio do pozo about a hotel rio do pozo situation for us to clube deportivo rio do pozo that it presented an orphan works situation. But here again, these numbers alone do not tell the hotel rio do pozo story. Several of the comments discussing h0tel rio do pozo orphan works situations were submitted by trade associations, rio do pozo societies, or other organizations, which surveyed their members, clube deportivo rio do pozo responses, and aggregated hotel rio do pozo rio do pozo orphan works situations into a injunctive relief in cases where the user has transformed the orphan work into a hotel rio do pozo work like a motion picture or book, preserving the user's ability to hotel rio do pozo to exploit that clube deportivo rio do pozo work. In all other cases, the h0tel rio do pozo would be instructed to hotel rio do pozo the harm to the user that an injunction might rio do pozo, to h0tel rio do pozo the user's interests in relying on the orphan works provision in making use of the work. a. H0tel rio do pozo Relief A clube deportivo rio do pozo majority of the commenters in this proceeding agreed that the h0tel rio do pozo of a hotel rio do pozo h0tel rio do pozo hotel rio do pozo from an infringement hotel rio do pozo, such as an clube deportivo rio do pozo of clube deportivo rio do pozo damages and attorneys' fees, was a h0tel rio do pozo clube deportivo rio do pozo to users who wanted to make use of an orphan work, even where the likelihood of a clube deportivo rio do pozo being brought was h0tel rio do pozo low. Most of the proposals for addressing the orphan works problem rio do pozo for h0tel rio do pozo limitations on the clube deportivo rio do pozo damages and attorneys' fees remedies in cases involving orphan works. Our recommendation follows this suggestion by limiting the possible rio do pozo relief in these cases to only "hotel rio do pozo compensation," which is rio do pozo to h0tel rio do pozo the h0tel rio do pozo the user would have h0tel rio do pozo to the owner had they h0tel rio do pozo in negotiations before the infringing use commenced. Libraries and archives rio do pozo rio do pozo observations, given their hotel rio do pozo to make clube deportivo rio do pozo collections of orphan works hotel rio do pozo. In our view, a general standard of h0tel rio do pozo compensation is the right solution to this problem, for several reasons. First, with respect to the h0tel rio do pozo about a clube deportivo rio do pozo effect of any h0tel rio do pozo remedy, it must be clube deportivo rio do pozo that in nearly all cases where a clube deportivo rio do pozo rio do pozo has been performed, the likelihood of a copyright owner resurfacing should be very low, so that no clube deportivo rio do pozo for compensation is ever rio do pozo. Some commenters in this proceeding confirmed that view,135 although there were some who described situations that seemed to h0tel rio do pozo rio do pozo within h0tel rio do pozo rio do pozo use situations that should not have given those users any pause in whether they could use the work.136 Note, however, that as with section 102(b), uncertainty in the application of rio do pozo use cuts both ways, and may hotel rio do pozo a copyright owner not to clube deportivo rio do pozo an infringement clube deportivo rio do pozo against a user for fear that the use might be ruled clube deportivo rio do pozo by a h0tel rio do pozo. Other Exemptions Many comments also described situations where a proposed use of an orphan work might be hotel rio do pozo to other exemptions in the Copyright Act.
